BY LAWS

OGLE COUNTY JUVENILE JUSTICE COUNCIL

 

Article I – Authority

 

            The Ogle County Juvenile Justice Council (hereafter referred to as “Council”) was created by and derives its authority from 705 ILCS 405 /6-12.

 

Article 2 – Purpose and Responsibilities

 

            The Council shall provide a forum for the development of a community – based interagency assessment of the local juvenile justice system, develop a county juvenile justice plan for the prevention of juvenile delinquency, and make recommendations to the county board for more effectively utilizing existing community resources in dealing with juveniles who are founded to be involved in crime. Related duties and responsibilities of the Council shall include but not be limited to:

 

  1. Develop a county juvenile justice plan base upon utilization of the resources of law enforcement, school systems, park programs, sports entities, faith community, and other in a cooperative and collaborative manner to prevent or discourage juvenile crime.
  2. Enter into written county interagency agreement specifying the nature and extend of contributions each signatory agency will make in achieving the goals of the county juvenile justice plan and their commitment to the sharing of information useful in carrying out the goals of the interagency agreement to the extent authorized by law.
  3. Apply for and receive public or private grants, to be administered by one of the community partners that support one or more components of the county juvenile justice plan.
  4. Provide a forum for the presentation of interagency recommendations and the resolution of disagreements relating to the contents of the county interagency agreement or to the performance by the parties of their respective obligations under the agreement.
  5. Assist and direct the efforts of local community support organizations and volunteer groups in providing enrichment programs and other supportive services for clients of local juvenile justice detention centers.
  6. Develop and make available a county wide or multi-county resource guide for minors in need of prevention, intervention, psycho-social, educational support, and other services needed to prevent juvenile delinquency.

 

Article 3 – Membership

 

            Each of the following county officers shall designate a representative to serve on the Council: the Sheriff, the State’s Attorney, Chief Probation Officer, and the county board. In addition, the chief judge may designate a representative to serve on the Council. The Council shall organize itself and elect from its’ Executive Board a chairperson and other offices as deemed necessary. Until a chairperson is elected, the State’s Attorney shall serve as the interim chairperson. Additional members to the Council shall be recommended as deemed necessary to accomplish the purpose of the Council and whenever possible shall appoint a local Chief of Police and a representative of a community youth service provider. The additional members may include, but are not limited to, representatives of local law enforcement, juvenile justice agencies, schools, businesses and community organizations.

 

Article 4 – Governance

                

            The Juvenile Justice Council shall be governed by an Executive Board. The Executive Board shall govern the Council and may exercise all of the powers necessary to effectuate the purposes of the Council consistent with the laws of the State of Illinois. The Council by and through the Executive Board may seek status as a not-for profit corporation and shall abide by the rules and regulations of the IRS as the same relates to tax-exempt organizations.

 

Section 1 – General Powers

 

The affairs of the Council shall be managed by the Executive Board.

 

Section 2 – Procedure

 

All matters of procedure not covered by these bylaws of by 705 ILCS 405/6-12 shall be governed by Robert Rules of Order Newly Revised. All Council Meetings shall be opened to the public and adhere to open meeting act.

 

Article 5 – Executive Board

 

The Executive Board shall consist of not be less than five (5) and not more than nine (9) members, four of which shall be the Chairperson, Vice Chairperson, the Treasurer and Secretary. The Executive Board may create other officer positions by a two-thirds vote.

A.     Chairperson: The Chairperson shall preside over all Council meetings. Subject to the direction and control of the Executive Board, he or she shall be in charge of the business affairs of the Council; he or she shall see that the resolutions and directives of the Executive Board are carried into effect except in those instances in which the responsibility is assigned to some other person by the Executive Board.

B.     Vice Chair: The Vice Chairperson shall assist the Chairperson in the discharge of his or her duties as the Chairperson may direct. In the absence of the Chairperson or in the event of his or her inability or refusal to act, the Vice Chairperson shall perform the duties of the Chairperson.

C.    Treasurer: The Treasurer shall keep correct and complete books and records of accounts and shall submit a financial report at each Council meeting.

D.     Secretary: The Secretary shall record and keep minutes of the proceedings at all meetings of the Executive Board and the Council.

 

The Executive Board members shall be nominated and elected to serve a two year term by a majority vote of the Council during the last calendar meeting of the year, usually in November.

 

The number of Executive Board members may be fixed or changed from time to time, within the minimum and maximum range established herein, by the Executive Board members without further amendment to the Bylaws.

 

Section 1 - Resignation and Removal

 

An Executive Board member may resign at any time upon written notice to the Chairperson. A Board member may be removed by majority vote of the Executive Board whenever it is judged in the best interest of the Council. Vacancies in any office whether occurring on account of resignation, death, or other cause, shall be filled by recommendation of the Membership Committee and a majority vote of the  Executive Board at the next meeting following notice or determination of the existence of a vacancy.

Article 6 – Juvenile Justice Council

 

The Executive Board members shall automatically be considered members of the Council. Additional members in the Council shall initially be appointed by the Chairperson.  After the establishment of the Council additional members shall be appointed by the Executive Board upon the recommendations of the membership committee. The number of Council members shall be not less than 10 and not more than twenty-five (25) voting members. The number of Council members may be fixed or changed from time to time, within the maximum range established herein, by the Executive Board members without further amendment to the Bylaws. Other persons who have a desire to participate in Council meeting, committees or are reporting on current programming are consider non-voting ad hoc members.

 

Section 1 – Resignation and Removal

 

Council member may resign at any time upon written notice to the Chairperson. A Council member may be removed by majority vote of the Executive Board whenever it is judged in the best interest of the Council. Vacancies on the Council whether occurring on account of resignation, death, or other cause, shall be filled by recommendation of the Membership Committee and a majority vote of the Executive Board.

 

1.      Voting Members of the Council assume obligation to regularly attend all meetings. If any Council member is absent four times during a twelve month period, the member shall be removed from the Council by the chair without a full Executive Board vote. Any member removed under this section may petition the Chair in writing for reinstatement to the Board/Council within thirty (30) days of the member’s removal and shall be reinstated by the Chair for reasonable good cause shown. Any member removed for violation of this section twice during the member’s term shall not have the opportunity for the petition or reinstatement during the member’s current term.

 

Article 7 - Committees

 

The Council shall seek to accomplish its purpose and goal through committees. Those committees shall be presided over by a chairperson from the Council membership to be appointed by the Executive Committee or elected by the Committee with approval of the Executive Board. The committees shall consist of not be less than three (3) and not more than eleven (11) members of the Council and other persons who have a desire to accomplish set purposes and goals. The Executive Board shall monitor and provide direction to the existing committees as deemed necessary. The Standing Committees of the Council shall include the following:

1.      The Membership Committee

2.      The Juvenile Justice Comprehensive Plan Committee

3.      The Publicity Committee

4.      The Educational and Programming Alternative Committee

5.      The BARJ and Law Enforcement Committee

6.      The Community Service Providers Committee

7.      The Treatment and Child Welfare Committee

 

Article 8 – Meetings

 

1.      The Executive Board shall meet as needed, but no less than every six (6) months.

2.      The Council shall meet six (6) times a year in the months of January, March, May, July, September and November.

3.      Each Committee shall meet as needed, but no less than every six (6) months.

Section 1 - Special Meetings

                   

Special meetings of the Council may be called by or at the request of the Chairperson or any two Executive Board members. The person or persons authorized to call special meetings of the Council may fix any place as the place for holding any special meeting called by them.

 

Section 2 - Meeting Notice

 

Meeting notice must comply with the open meetings act which includes but is not limited to Public posting and notification at least 48 hours prior to each meeting. Notice shall be in writing and mailed in the U.S. Mail or sent by email to the address or email address of each member listed on the membership/committee roster. Meeting notices shall be accompanied by minutes of the last prior meeting and the agenda for the next scheduled meeting. Council members shall maintain current address information with the Secretary in order to facilitate proper and timely notice.

 

Section 3 – Meeting Minutes

 

The Secretary shall prepare and maintain minutes of each Council meeting. The minutes shall reflect the matters discussed and results of any vote. The Chair of each committee (unless decided otherwise) shall prepare and maintain the minutes and agenda for each committee meeting, which shall reflect the matters discussed and results of any vote. A copy of minutes of the prior meeting shall be provided to members and the Executive Director at least 48 hours prior to the next scheduled meeting, either by U.S. Mail or email.

 

Section 4 – Informal Action by Members

 

The Authority of the Executive Board may be exercised without a meeting if consent in writing, setting forth the action taken, is signed by all the Executive Board members entitled to vote.

 

Section 5 – Quorum

 

A majority of the current and present voting Executive Board Members, Council, or Committee shall constitute a quorum for the transaction of business at any meeting.

 

Article 9 – Executive Director

 

The Executive Director is a part-time paid position supervised by the Executive Board and shall serve at the Direction of the Chairperson.  The Executive Board shall determine the salary and the manner of payment. The Executive Director shall have responsibility of oversight of any program sponsored or linked to the Juvenile Justice Council and in that capacity shall have access to any relevant information including police reports and juvenile records.

 

Article 10 – Youth Diversion Fund

 

Pursuant to 55 ICLS 5/5-1101(e), Ogle County Board resolution passed and adopted on March 15, 2005 an Administrative Order 2005-1 signed on July 25, 2005 by Presiding Judge Stephen Pemberton, a Youth Diversion Fund was established in Ogle County, Illinois. Monies collected by the Ogle County circuit Clerk’s Office pursuant to Administrative Order 2005-1 shall be remitted monthly to the Ogle County Treasurer for deposit in the Dependent children’s Fund line item entitled ”Juvenile Diversion Fund”

Section 1  Budgetary by-Law Amendment made 3/08 -

 

To improve oversight and financial planning related to the Youth Diversion funds or another dollars controlled by the Juvenile Justice Council, any agency or person requesting funds must have a budget approved by the Juvenile Justice Council.

1.  A budget must be submitted along with a program description to Greg Martin, Treasurer, no later than May 1st of every year.

2.  A meeting of the Executive Committee will be held prior to the regular Juvenile Justice Council meeting.  The person(s) submitting a budget will be invited to attend the Committee meeting to discuss the budget.

3. Budgets must be approved by the full Council prior to June 1st.

 

Article 11- Amendments of Bylaws

 

The power to alter, amend, or repeal the bylaws or adopt new bylaws shall be vested in the Executive Board, unless otherwise provided in the bylaws. Such action may be taken at a regular or special meeting for which written notice of the purpose shall be given. Any alteration, amendment or repeal of the bylaws shall be accomplished by at least two thirds vote of the officers present at this meeting.
