Drinking Diversion Program

 

Youth arrested for a first time underage drinking offense, under the age of 21, will be offered the opportunity to participate in the Deferred Prosecution Program, which will minimize legal costs and avoid a criminal conviction on their record.

The first step is to discuss the charges with the Ogle County State's Attorney's Office.  If this is a first offense and the State's Attorney agrees that participation in the Deferred Prosecution Program is appropriate, the youth and their parent/guardian must agree to participate in an assessment appointment at one of the office locations of Sinnissippi Centers.

The assessment appointment will determine what form of services are necessary- either education or treatment.  The assessment appointment is a time for the youth and parent/guardian to meet with a clinician to gather family history, social history, history of substance abuse use and information regarding and other problems that might be occurring in the youths life.  Once completed, the clinician will talk with the youth and their family about the treatment recommendations.

Deferred Prosecution participants will be referred to either an education program or treatment program.  This will be based upon the severity of the substance use.

 

The Deferred Prosecution Education Program

The cost of the Deferred Prosecution Education Program is $400.00, and includes the cost of the assessment, education sessions, parent group and discharge session.  A deposit of $200.00 must be paid at the beginning of services and the remaining $200.00 is due no later then the fourth meeting with the clinician.

The youth will participate in 10 hours of either individual or group services.  The content of these sessions will focus on :

  • the effects of alcohol and other drug use

  • the consequences of alcohol and drug use

  • ways to avoid alcohol and other drug use

The parent/guardian will be required to attend on parent group to discuss the consequences related to their child's use of alcohol and other drugs as well as their responsibility as parents.

 

The Deferred Prosecution Treatment Program

The cost of treatment services will be set using a sliding fee scale based upon the youth's family size and family income.

Youth who present with a more pervasive alcohol use will be required to participate in a group treatment program dependant upon severity of use.  The treatment program may range from 12 hours to over 75 hours. 

The parent/guardian will be required to attend one parent group to discuss the consequences related to their child's use of alcohol and other drugs as well as their responsibility as parents.

 

To be considered a successful completion:

  • Youth must participate in all services and complete any assignments.

  • Their parents and/or guardian must participate in the initial assessment appointment, the parent group and the final discharge session.

  • The youth must have no additional legal charges during their participation in service.

  • A certificate of completion will be presented to the youth and a copy will be sent to the Ogle County State's Attorney's Office.

Provided the youth has fulfilled all of the above requirements, a criminal conviction for underage drinking will not go on their record.
